Most properties have a PUE. PUE meansPublic services. Like other equipment, the PUE grants certain rights to the owner of the installation. If you own your home, PUE can explain why you wake up to find an electrician on a power pole in your yard without first asking your permission (i.e. the force of the power company will usually contact you before sending someone to invade your garden – but, legally, they don’t have to).

Our real estate attorneys are experienced in dealing with PUEs and similar matters.

The purpose of setting up an easy widget

The PUE (in California) derives from the provisions of the Government Code, Section 66475. Section 66475 provides that, as a condition of approval of a subdivision map, local governments may require subdivisions to provide real estate assets for the PUE. The PUE is not issued on public roads and highways, but is issued whenreal estate purchased by the buyerof subdivided lots. These provisions are not granted to the county; instead, amenities are reserved for public utility purposes. The PUE, in its express terms, defines the type of person who has an interest or right in the use of the facility, and these mitigations do not extend the rights to the general public or the county specifically. Influence of PUE

Now, as a landlord, the existence of a PUE on your property may limit your ability to use the part of the property that the equipment includes. For example, let’s say there are 10′ PUEs on your property. If you have trees near the PUE or if branches enter an area covered by the PUE, you can go home to find the utility company to prune your trees without your permission – they are usually allowed to do this, it is legal.

Summary, before buying a property, you want to make sure you know what you’re buying, and that includes knowing all the existing PUEs – and other add-ons.

Most CPUEs will be disclosed in a general report. However, to be on the safe side, you may want to verify the pre-registered zoning map with your county registry office.

The most common easements are driveways. If a house is located behind another house, and they share a driveway, the homeowners in the back will have the right to use the driveway to access their house.

Real estate easements exist everywhere.

Even utility companies use easements to access private land. They can use utility easements to fix a down electric pole or trim an overhanging tree obstructing powerlines.

Robert Rico shares the legal terminology and how easements work in this in-depth video on real estate law.
